Terms of Service

1. Acceptance of Terms

By creating an account or using Nano ("we", "us", "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service. These terms apply to all visitors and registered users.

2. Description of Service

Nano is an AI chat companion that lets you converse with multiple AI models, store conversation history, generate documents, images, and videos, manage preferences across sessions, and build custom AI assistants. The service includes:

• AI chat: conversation with multiple third-party AI models, personalized memory, and personality modes.
• File, image, and video generation: documents, spreadsheets, images, and short videos with audio, depending on your plan.
• Custom GPTs: user-created AI assistants with custom instructions, actions, and OpenAPI-defined tools.
• API access: programmatic API keys for integrating Nano into your own applications (Max plan).
• Team projects: shared workspaces with invite codes, role-based access, and pooled usage (Business plan).
• NanoCall: optional phone number linking for account login and notifications.

We may change, suspend, or discontinue any part of the service at any time without prior notice.

3. Accounts

You must provide accurate account information and keep it current. You are responsible for safeguarding your password and for all activity under your account. If you link a NanoCall phone number, you are responsible for keeping that number secure. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Subscription Plans and Payments

Nano offers four subscription plans:

• Free ($0/mo): 3 starter AI models, 5 messages every 2 hours, personalized memory, file attachments, image analysis, voice input, personality modes, games, and 3 web searches per day.
• Pro ($10/mo): 5 models including web search, 160 messages every 3 hours, unlimited live web search, image generation (10/day), spoken replies, chat export and search, chat summary, rename chats, writing tools, priority new-model access, and coding explain/debug (not full write/refactor).
• Business ($35/mo): 9 models including web search, 250 messages every 3 hours, image generation (50/day), video creation (2/day with audio), full AI coding, PDF export, regenerate responses, pin and duplicate chats, meeting notes, business name and custom branding, invoice-ready billing, usage analytics, shared team projects with invite codes and roles (owner/editor/chatter), team message pooling, shared knowledge sources, SWOT/project-plan/draft-email/meeting-agenda templates, and priority support.
• Max ($30/mo): All models (current and future), unlimited messages and uploads, image generation (200/day), video creation (5/day with audio), full AI coding, PDF export, regenerate, pin/rename/duplicate, branch/fork chats, custom AI personas, chat templates, deep research, code review, literature review, extended memory, priority processing, priority support, and early flagship previews. Does not include Business-only team features.

Paid plans are billed through our payment processor (Stripe) on a recurring monthly basis until you cancel. Plan features, pricing, and usage limits are described on our pricing page and may change with reasonable notice.

• Payments are processed securely by Stripe; we do not store your full card details.
• You may cancel your subscription at any time; access continues until the end of the current billing period.
• Refunds are handled on a case-by-case basis — contact support to request one.
• We may adjust pricing with prior notice; existing subscriptions are unaffected until renewal.

5. Custom GPTs, API Keys, and Team Projects

Custom GPTs (custom AI assistants) you create are tied to your account. You may publish and share them via share links. You are responsible for the content and actions of assistants you create, including any OpenAPI-defined actions that call external services. API keys (Max plan) grant programmatic access to Nano's API — keep them secret and rotate or revoke them from your settings if compromised. Team projects (Business plan) are shared workspaces; the project owner controls membership, roles, and content. Team members' usage counts toward the project's pooled message limit.

6. Acceptable Use

You agree not to:

• Use Nano for unlawful, harmful, fraudulent, or infringing activities.
• Generate or distribute content that is abusive, harassing, or violates others' rights.
• Attempt to reverse engineer, disrupt, or overload the service or its infrastructure.
• Share your account credentials, API keys, or resell access without permission.
• Use automated scripts to abuse usage limits or bypass plan restrictions.
• Use API keys or custom GPT actions to scrape, spam, or harm third-party services.

AI-generated content may be inaccurate or inappropriate. You are responsible for reviewing outputs before relying on them.

7. Intellectual Property

We retain all rights to the Nano service, including its design, branding, and software. Content you create — such as your prompts and uploaded files — remains yours. You grant us a limited license to process your content solely to provide and improve the service. Custom GPTs you publish may be shared via public links at your discretion.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that AI outputs are accurate, complete, or fit for a particular purpose. You use Nano at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Nano and its operators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the twelve months preceding the claim.

10. Termination

You may delete your account or stop using Nano at any time. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice. Upon termination, your right to use the service ends immediately. API keys are revoked and team project memberships are removed.

11. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes. Continued use of Nano after changes take effect constitutes acceptance of the revised Terms.
